SBA's rules state the program's purpose in one sentence: to assist eligible small disadvantaged business concerns compete in the American economy through business development 1.
The basic test is about who owns and runs the company. Generally, a concern qualifies if it is a small business unconditionally owned and controlled by one or more socially and economically disadvantaged individuals who are of good character and citizens of and residing in the United States, and it demonstrates potential for success 2.
Participation is time-limited. A participant receives a program term of nine years from the date of SBA's approval letter admitting it 3, and must maintain its program eligibility throughout 4.
How 8(a) contracts are awarded
The program works through SBA. It authorizes SBA to enter into all types of contracts with other agencies and award subcontracts for performing those contracts to firms eligible for program participation 5.
Contracts may be awarded to SBA for performance by eligible 8(a) participants on either a sole source or competitive basis 6.
One condition for competing a requirement among 8(a) firms is a reasonable expectation that at least two eligible and responsible 8(a) participants will submit offers and that award can be made at a fair market price 7.
The same section also sets a competitive threshold amount, and a requirement estimated above it cannot be cut into pieces to get under it: it shall not be divided into several requirements for lesser amounts in order to use 8(a) sole source procedures for award to a single firm 8.
